Buddha Studio Contract
As of 24 May 2017, I will no longer be doing Akai tape transfers. My machine is corroded beyond repair, and I currently have no intentions of purchasing another tape machine. Thank you very much for your support over the years, and apologies for any inconvenience this may cause.
I've had either an Akai MG1214 or, for the past few years, this 14D rackmount tape machine for many years. I have been recording to Pro Tools for many years now, but still kept the Akai machines going because I kept getting asked to do tape transfers. That has come to an end, and I am without doubt one of the very last studios to offer that service. The end of an era.
We transferred over 450 tapes, sometimes bringing beautiful memories to people. Thank you so much for your kind words and patronage over the years.
Payment
Payment in full is expected at the beginning of the recording session. All
mixes, CD-Rs, DATs and master tapes, drives, etc. shall remain the property of
Blueberry Buddha Recording Studios until all invoices are paid in full by the
client.. There are also materials costs as described below. We accept cash,
money orders, credit cards via PayPal or PayPal to elevenshadows@yahoo.com. If you
prefer personal check, please notify me in advance. Any personal check returned
for insufficient funds shall deem this agreement terminated immediately and
shall be responsible for the payment and any fees or costs incurred. The artist
is responsible for any and all legal costs and attorney's fees, etc., required
to collect payment for said check.
Booking and Cancellation
A
nonrefundable deposit of 50% shall be required to confirm all bookings.
Cancellation with less than 48 hours notice when recording drums shall result in
payment in full due for the session except for death of a relative or extreme
illness. Cancellation with less than 24 hours notice shall result in
payment in full due for all other types of recording sessions except for death
of a relative or extreme illness. No further sessions shall be booked, and
no materials will be released until payment for cancellation is made in full. A
session begins at the time the client booked it for, whether they are present or
not, and continues until the recording has ceased and clients are preparing to
leave. This includes rmaking CD-Rs rough mixes.
Setup Time and Breaks
Setup time and breaks will be billed at the agreed upon hourly rate. Expect
several hours of setup time if you are a full band. The engineer will break for
10 minutes every 2 hours to alleviate ear fatigue, and will take one 45-minute
meal break every 5 hours. All this time is on the clock.
Rates
Our studio rate is variable, depending on the project, and includes an engineer. There is a minimum
booking time of 4 hours. Additional hours over 8 hours are billed at 1.5x the
agreed-upon rate. Please
contact me for rates.
CD-Rs
are .50 each plus time at the hourly rate. Please note that these will not be
given out until full payment of the session is given.
DVD-Rs are $1.00 each. DVD-R back up and archiving is done at the hourly rate.
Each DVD-R holds 4.5 gigabytes. Please note that these will not be given out
until full payment of the session is given.
Daily back-up to the studio’s firewire external hard drive is free for each
recording session. Backing up to the client’s firewire or USB external hard
drive will be billed at the hourly studio rate.
Onsite hard drive storage is free for one month after the last recording
session, and $10 per gigabyte thereafter, billed in 1-week increments in
advance. Non-payment for storage will result in permanent deletion of the files.
Ongoing projects that are booking time on a regular basis (8+ hours/month) are
exempt.
Facility Rules
Outdoor Noise
Please understand that this is a residential location and that there are
neighbors. In order to preserve their needs for a quiet neighborhood, noise
should be kept to a minimum while outside of the house.
Smoking
There is no smoking inside the house. You may smoke in the back yard, but please
do not leave butts or matches on the ground as ashtrays are provided for this
purpose.
The Cats
There are two cats that live on the premises. If you have cat allergies, please
notify so I can purify the air for you. Please do not feed the cats.
Trash
Please be considerate about leaving trash around the grounds and the facility.
Your momma does not work here. You will be expected to clean up all any mess
that you make. Please leave all trash in the wastepaper baskets or in the trash
container outside. Recycle all glass and aluminum by placing it in a bag on the
kitchen floor near the exterior door.
Parking and Car Alarms
If you have a car alarm, please be considerate about setting it off in the late
hours of the night.
Use of Alcohol and Illegal Substances
No illegal substances are allowed on the property. Any behavior deemed
unprofessional by the house engineer of artist, artist’s guests or crew while
under the influence of any substance will result in immediate termination of
this agreement. No drinks are to be consumed in the control room or near any
equipment.
Equipment
You are liable for any and all damage caused by clumsiness, horseplay, or
intoxication to both your own equipment and ours (and to anything in the house).
You will be solely liable for all equipment broken under these circumstances. We
are not responsible for your equipment or persons in any way.
Guests and Visitors
A full band can have up to two guests (people not playing an instrument). Please
inform your guests to not be a distraction to the session. If your guests are
disruptive to the session, they will be asked to leave. You are responsible for
any and all damage caused by clumsiness, horseplay, or intoxication caused by
your guests.
Liability
My Akai MG1214 is kept in pristine condition, is maintained regularly, and is
de-magnetized before and after every session, and my tape transport is kept
extremely clean and operational. However, Akai MG1212 and MG1214 tapes are
old, may have been exposed to heat or water or otherwise improperly stored, and
did I mention that they are OLD? Therefore, I will not be held responsible
for any damage to your tapes while in my machine.
I am not responsible for any shipping problems
that occur after I drop it off at UPS or the post office. I am not
responsible for any shipping problems which occur before I receive the tapes.
Signature by artist or artist's representative below acknowledges these rates
and rules are in effect, and exempt Ken Lee and Blueberry Buddha Studios from
any liability to either persons or equipment.
Should any portion of this Agreement prove to be invalid, illegal or
unenforceable, it shall not affect the balance of this Agreement. This Agreement
is guided by and governed by the laws of the State of California and Los Angeles
County shall be the place of execution and jurisdiction.
Should any litigation arise between the parties hereto regarding the performance
of this Agreement, the prevailing party shall be compensated for whatever
damages are awarded, plus reasonable attorney's fees by the other party.
This Agreement is the complete understanding between the parties and supersedes
and replaces all previous agreements or representations both written and oral.
